This Legal Advice regulates the access to and the use of the website hosted under the domain name www.biomii.com (hereinafter “Website“) and under any of the sub-domains or web pages dependent on it, as well as the content and services that the owner of the Website makes available to its users and establishes, together with the Privacy and Cookies Policy, regarding the management of personal data of users, the terms and conditions governing the Website.

The access to the Website or its use by the User necessarily implies, and without reservations, the knowledge and acceptance of the Terms and Conditions. Therefore, it is recommended that the User reads them carefully each time he/she wants to access the Website.

  1. Purpose

With these Terms & Conditions of use we want all users to know what their rights and obligations are from the moment they visit our website.

Likewise, we inform users about their rights and obligations in relation to the contents displayed through the platform, logos and brands used, as well as the responsibilities that may arise from the use of the service.

All users expressly and unequivocally accept the conditions of use and the privacy policy, as well as the various modifications and/or additional legal texts that may be included in the future. If you do not agree with any of the conditions, you can unsubscribe from the service at any time.

For the purposes of interpretation of these conditions, we understand that a person becomes a user at the time it accepts the conditions of use and privacy policy set out in the website, just by clicking on  it.

We are deeply committed to making sure that the service works properly and according to the conditions agreed upon with our users. However, on occasions it is possible that situations may arise, especially due to the intervention of malicious third parties, which could lead to liability.

In this sense, below we indicate those situations in which we are not responsible for the actions of users, assuming all the responsibilities:

In case it appears published on the website or platform information that had not been hosted by us or that has been published by a third party outside the organization.

In case the website and platform is not operational for technical reasons attributable to third parties or unforeseeable causes or force majeure.

In case the user stores, disseminates, publishes or distributes on the website any type of defamatory, injurious, discriminatory, inciting to violence or against morality, public order, fundamental rights, public freedoms, honor, privacy or image of others.

In the event that any of the content accessible through the website or platform is contrary to the regulations in force, we undertake to remove it immediately, as soon as we become aware of and corroborate the facts.

Our antivirus system is reasonably secure. Therefore, Biotech is not responsible for the potential damage or errors that, due to the presence of any virus, may suffer the computer system (hardware or software) of the Users when they access or use the Website.

We are deeply committed to protecting and defending intellectual and industrial property rights. Therefore, we inform you that:

Under no circumstances may it be understood that we grant users any right or license to exploit the contents displayed on the website beyond what is strictly necessary for their visualization.

We guarantee that all the contents that we make available are completely original and adequate to the national legislation in force, being all of them protected by intellectual property rights. In those cases where we do not have the ownership of the contents, we have all the rights related to public communication, distribution and/or reproduction or any other rights as required by law to use and display said contents.

All logos, brands and commercial names displayed through the website or the platform, are our property or are property  of third parties who have granted us authorization to use and / or exploit them.

None of the contents hosted on the platform can be downloaded, reproduced or used in any other device or place other than our website, unless we have enabled the means to do so or you have been expressly authorized in writing by us.

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation – GDPR), all personal data provided during the use of the website will be processed in accordance with the provisions which every user must expressly accept in order to use and register in the system.

All users who accept these conditions of use, accept in an informed, express and unequivocal way our data protection policy, assisting in this sense the rights of access, rectification, deletion, opposition, limitation of treatment and, where legally appropriate, portability, with respect to their personal data, being able to exercise them as reported in the mentioned .

The Users will be entirely responsible for the correct use of the Website subject to the current legislation, either national or international, as well as to the principles of good faith, morals, good customs and public order, and with the commitment to diligently observe any additional instructions that may be given by Biotech.

The Users will refrain from using the services and contents of the Website for illicit purposes or effects and that are harmful to the rights and interests of third parties, or that in any way may damage, disable, affect or deteriorate the operation of the Website, its contents and services. It is also forbidden to prevent other Users from using or enjoying the Website.

Biotech will make the reasonable means available to the User so that the contents and services included in the Website are accurate and up-to-date. Nevertheless, Biotech is not in condition to neither does it guarantee this circumstance at all times. Likewise, Biotech will not be responsible for the functioning of the communication networks that make possible the operation of the Website, whether fixed or mobile, whose responsibility lies entirely with providers outside of Biotech.

If it considers it appropriate, Biotech will be able to suspend immediately the provision of the service and, in its case, to remove the contents that it considers incorrect or illegal, either at its own discretion, or at the request of a third party affected or of a competent authority, without this suspension givingrise to any compensation for the user.

Biotech does not assume any responsibility derived from the links that make possible, through the Website, the access to the User to benefits and services offered by third parties, as long as they are not related to the Website. Therefore, Biotech is not responsible either for the information contained in them or for any effects that may derive from such information. Furthermore, Biotech reserves the right to withdraw, unilaterally and without prior notice, the links that appear on the Website.

  1. User account closure and service suspension

Biotech reserves the right of admission and exclusion of any user from the Website. Any User who does not comply with the rules described above may be excluded from the Website.

Also, Biotech, may withdraw or suspend at any time and without prior notice the provision of the Services to those Users who do not comply with the Terms and Conditions.

  1. Dispute Resolution

For all litigious matters or those that concern our website or any of those that depend on it, Spanish law will be applicable, being competent for the resolution of all conflicts derived or related to the use of this website, the Courts of the city of Madrid, Spain, inasmuch as permitted by law.
